1. Scope

1.1 These General Terms and Conditions (hereinafter "GTC") apply to all contracts for the purchase of goods concluded between

(hereinafter "Skynclothing e.U.", "we", "us", or "Seller")

and our customers (hereinafter "Customer") via our online shop www.skyn-clothing.com.

2. Subject Matter of the Contract

2.1 Skynclothing e.U. offers the following goods for purchase via the online shop:

• Activewear, Sports bras, Shorts, Leggings, Tops, Jumpsuits

• And in the future, in particular: Jackets, Jogging suits, Shoes, Accessories, Merchandise, Water bottles, and other goods of all kinds.

3. Conclusion of Contract

3.3 The purchase contract is concluded only through:

• Sending an order confirmation, or

• Dispatching the goods.

  Skynclothing e.U. reserves the right to reject orders without stating reasons, in particular in cases of obvious pricing errors, technical errors, suspicion of fraud, or unavailability of the goods.
  

4. Prices

4.4 Any applicable:

• Customs duties

• Import charges

• Import VAT

• Other fees outside the European Union

  are to be borne by the customer, unless otherwise expressly agreed.

5. Payment Terms

5.1 The customer may choose from the payment methods offered in the online shop. These include in particular:

• Credit card, PayPal, Klarna, Apple Pay, Google Pay, Shop Pay, EPS, and other payment options displayed at checkout.

  6.2 The payment method is charged according to the terms of the respective payment service provider.

  6.3 If an external payment service provider (e.g., PayPal or Klarna) is selected, their terms and conditions and privacy policies apply additionally.

  6.4 Skynclothing e.U. reserves the right to exclude certain payment methods for specific orders or countries.

  6.5 The customer is obliged to provide all information completely and truthfully. In case of suspected fraud or abuse, Skynclothing e.U. reserves the right to cancel orders or request additional proof of identity.

6. Delivery and Shipping

6.1 Delivery is made exclusively to the delivery addresses specified in the order process.

6.2 Skynclothing e.U. currently ships to:

• Austria, EU Member States, selected European non-EU states, Canada, United States of America, United Arab Emirates, and potentially other countries if selectable in the online shop.

  6.3 Delivery times are indicated in the order process or on the product page. All delivery times are non-binding guidelines unless expressly agreed otherwise.

  6.4 Skynclothing e.U. is not liable if a product is temporarily unavailable or if delivery is delayed due to force majeure, strikes, natural disasters, official measures, or other unforeseeable events.

  6.5 If the customer provides incorrect or incomplete delivery information, any resulting additional shipping costs are to be borne by the customer.

  6.6 For consumers, the risk of loss or damage to the goods generally passes only upon handover of the goods to the customer or an authorized recipient.

  6.7 Shipments outside the European Union may be subject to import charges, customs duties, or other official levies. Unless stated otherwise, these are to be borne by the customer.

7. Retention of Title

7.1 Delivered goods remain the property of Skynclothing e.U. until all claims from the respective purchase contract have been paid in full.

7.2 Resale for commercial purposes prior to full payment is prohibited without prior written consent from Skynclothing e.U.

8. Vouchers and Discount Campaigns

8.1 Discount codes and promotional vouchers can only be redeemed within the specified validity period.

8.2 Generally, only one discount code can be redeemed per order unless otherwise specified.

8.3 Cash payment or retrospective credit for already expired or unused discount codes is excluded.

8.4 Skynclothing e.U. reserves the right to change, extend, or end discount campaigns at any time for objective reasons.

8.5 In case of abuse, Skynclothing e.U. may cancel orders or exclude customers from future campaigns.

9. Right of Withdrawal

9.1 Consumers are generally entitled to the statutory right of withdrawal in accordance with applicable Austrian and European consumer law.

9.2 Further information can be found in the separate Cancellation Policy, which is part of the online shop.

9.3 The statutory right of withdrawal remains unaffected by these GTC.

10. Returns

10.1 Regardless of the statutory right of withdrawal, returned goods must be:

• Unworn, unwashed, free of signs of wear, free of odors (e.g., perfume, smoke, sweat), complete, provided with all original labels, and in original packaging (if reasonable).

  10.2 Skynclothing e.U. reserves the right to claim compensation for diminished value if the goods have been used beyond what is necessary to check their nature, properties, and functionality.

  10.3 For hygienic reasons, returns may be excluded if permitted by law and if sealed products have been opened or unsealed after delivery.

  10.4 The direct costs of returning goods are borne by the customer unless otherwise required by law or a defect for which Skynclothing e.U. is responsible exists.

  10.5 Refunds are made exclusively via the same payment method used by the customer for the original order, unless otherwise required by law.

11. Quality Control

11.1 All goods are carefully checked before shipping.

11.2 Should a defect exist despite quality control, the customer is asked to contact Skynclothing e.U. immediately and document the defect with photos if possible.

11.3 Statutory warranty rights remain unaffected.

12. Warranty

12.1 Statutory warranty provisions of Austrian law apply.

12.2 Normal signs of wear, typical usage fatigue, or damage due to improper handling, care, or storage do not constitute a warranty case.

12.3 Color deviations due to different screen displays or minor production-related deviations do not constitute a material defect.

12.4 The customer is obliged to document obvious transport damage with the carrier if possible and inform Skynclothing e.U. promptly.

13. Liability

13.1 Skynclothing e.U. is fully liable for damages caused intentionally or through gross negligence.

13.2 In the case of slightly negligent breach of essential contractual obligations, liability is limited to foreseeable, contract-typical damage.

13.3 The above limitations do not apply to damages resulting from injury to life, body, or health, or claims under mandatory statutory provisions.

13.4 Skynclothing e.U. assumes no liability for delays or performance obstacles beyond its control, especially due to force majeure, pandemics, or carrier failures.

14. Pre-Orders

14.1 Estimated shipping dates are provided as orientation and are not binding delivery dates.

14.2 If shipping is delayed due to production or transport issues, we will inform the customer promptly.

15. Waitlist

15.1 Registration on a waitlist does not constitute a right to purchase a product.

15.2 Skynclothing e.U. does not guarantee access to limited products; Early Access invitations are at our sole discretion.

16. Gift Vouchers / 18. Discount Codes

16.1 Gift vouchers cannot be paid out in cash and cannot be used to purchase further vouchers. Lost vouchers are not replaced.

16.2 Discount codes may be excluded for limited collections, special editions, pre-orders, or already reduced items.

17. Product Representations

17.1 Minor deviations in color, material, or size due to screen settings, lighting, or production tolerances do not constitute a defect.

18. Care Instructions

18.1 Customers must observe product label care instructions; damage due to non-compliance voids warranty claims.

19. Intellectual Property

19.1 All content (logos, photos, text, designs) is protected by copyright/trademark law. Usage without written consent is prohibited.

20. Misuse

20.1 Any misuse (bots, fraud, manipulation) is strictly prohibited. Skynclothing e.U. reserves the right to block accounts and pursue legal action.

21. Applicable Law

21.1 Austrian law applies, excluding the UN Sales Convention. Mandatory consumer protection laws of the customer's country of residence remain unaffected.

22. Alternative Dispute Resolution

22.1 European Commission Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr. Skynclothing e.U. is generally not prepared to participate in dispute resolution proceedings before a consumer arbitration board.

23. Severability / 24. Final Provisions

23.1 Should any provision be invalid, the remaining provisions remain effective.

24.1 Changes must be in text form. The version of the GTC published at the time of the order applies.

25. Rabattcodes

25.1 Discount codes are only valid within the specified promotional period.

25.2 Discount codes may be excluded for:

• limited collections
  
• Special editions
  
• Pre-orders
  
• already reduced goods

25.3 Skynclothing e.U. reserves the right to deactivate discount codes in the event of obvious abuse or technical errors.
